Official Contest Rules & Terms
Eligibility: The Contest is open to legal residents of the United States, who are eighteen (18) years of age or older. You must be eligible to Hunt in New Mexico as a resident or nonresident and hold a valid Hunting license and have made a purchase of either a Hunt Premium Membership or Hunt Elite Membership to be eligible to win the Grand Prize. A purchase is also necessary to be eligible to win a Second Prize Package, but is not necessary to be eligible to win a Third Prize Package. Employees of Sponsor and their family members are prohibited from entering. Entrants are subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
Sponsor: The Contest is sponsored by OnXmaps, Inc., 1925 Brooks Street, Missoula, MT 59801 (“Sponsor”).
Agreement to Official Rules: By participating in this Contest (the “Contest”), entrants agree to abide by the terms and conditions thereof as established by Sponsor. Sponsor reserves the right to qualify all submissions and to reject any submissions that do not meet the requirements for participation as established by Sponsor.
Contest Period: The Contest begins on September 27, 2016 at 09:00 AM MDT and ends on October 31, 2016 at 11:59 PM MDT (“Contest Period”). Entries received before or after the Contest Period are void. Sponsor’s computer is the official time-keeping device for the Contest.
How to Enter: Download the free onXmaps mobile app for Android or iOS devices and register for a free Hunt Membership account; or register for a free Hunt Membership account at onxmaps.com/web. During the Contest Period, new and existing Hunt Membership users who are logged into the Hunt App or Hunt on Computer will find the entry form. Alternatively go to onxmaps.com/pronghorn-with-the-pros and complete the entry form, in which we ask that you tell us in twenty five (25) words or less about your dream Hunt (each, an “Entry”). Limit one Entry per person. All Entries must be complete and received before the end of the Contest Period to be eligible to win. All duplicate Entries will be void. Anyone found to use multiple accounts to enter will be ineligible. Use of computer programs and/or other automated devices to enter the Contest is prohibited. Normal Internet access and device usage charges imposed by your on-line service may apply. Sponsor reserves the right to disqualify any non-conforming entries.
Sponsor assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections that are human or technical in nature, or for damaged, lost, late, illegible or misdirected entries; technical, hardware, software, electronic or telephone failures of any kind; lost or unavailable network connections; fraudulent, incomplete, garbled or delayed computer transmissions whether caused by Sponsor, the users, or by any of the equipment or programming associated with or utilized in this Contest; or by any technical or human error that may occur in the processing of submissions or downloading, that may limit, delay or prevent an entrant’s ability to participate in the Contest.
Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest and award a prize from Entries received up to the time of termination or suspension should virus, bugs or other causes beyond Sponsor’s control, unauthorized human intervention, malfunction, computer problems, phone line or network hardware or software malfunction, which, in the sole opinion of Sponsor, corrupt, compromise or materially affect the administration, fairness, security or proper play of the Contest or proper submission of Entries. Sponsor is not liable for any loss, injury or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in this Contest.
Use of Entries by Sponsor: By submitting an Entry, each participant grants, approves, and authorizes Sponsor the irrevocable right to use, link to or from, or otherwise exhibit, distribute, or display the submitted Entry in its original form or in any altered form or format. In particular, at any time Sponsor may upload, reformat, edit, copy, reproduce, display, or distribute the submitted Entry, or make the Entry accessible and available on the Internet or by any other means without further notice or compensation to the participants. Each participant grants Sponsor the unqualified, unrestricted, worldwide, irrevocable, perpetual, and royalty-free right to use his or her name, Entry, and other distinctive identification in connection with promoting or marketing activities without limitation and without further notice or compensation. Sponsor has no obligation to post or display any Entry.
Selection of Winner: The prize winners will be determined by a panel of judges selected by the Sponsor who will assess and score each Entry based on creativity (25%), composition (25%) and fit with the onXmap brand (50%). The entrant whose Entry achieves the highest score shall be selected as the Grand Prize Winner. The one hundred (100) entrants with the next highest scores will each receive one (1) Second Prize Package and the next five (5) entrants will each receive one (1) Third Prize Package.
Notification of Potential Prize Winner: If your Entry has been drawn as the Grand Prize Winner, you will be contacted within seven (7) days after the judges finish scoring the entries by telephone, email or mail, per the information indicated in your online entry form, to confirm your Entry and eligibility. If your Entry has been selected to win a Second Prize or a Third Prize, you will be notified within seven (7) days of the competition of scoring. To be confirmed a winner of any prize, you may be required to complete and return an affidavit of eligibility and release form (except where prohibited) before being awarded your prize. If a winner does not meet all eligibility requirements, has not complied with these Official Rules, cannot be contacted, does not respond within seven (7) days from the date Sponsor first tries to notify him/her, and/or the prize notification is returned as undeliverable, such winner forfeits all rights to claim or receive the prize and an alternate winner will be selected using the methods described above. By accepting any prize, the winner acknowledges compliance with these Official Rules. If any prize is not won and claimed by an eligible winner in accordance with these Official Rules, it will not be awarded and will remain the property of Sponsor.
Prizes: Grand Prize – The Grand Prize Winner will receive a Hunt adventure with Randy Newberg of On Your Own Adventures & Matt Seidel of onXmaps to take place in New Mexico and a Sitka full kit, which includes: one (1) Core Crew Core Crew LS; one (1) Mountain Jacket; one (1) Mountain Pant; one (1) Mountain Gloves; one (1) Sitka Cap; one (1) Leupold BX-3 Mojave HD 10×42; one (1) Leupold GO Afield Bino Harness; one (1) Phone Skope Gift Card $80; one (1) SneekTec Sneek Boots; one (1) Dark Energy Poseidon Portable Charger; one (1) Voke90 Challenge + 3 extra months Reload and one (1) #Huntsmarter Gear Package. The Grand Prize includes round-trip coach class airfare for the Grand Prize Winner from an airport within the 48 contiguous United States reasonably close to the Grand Prize Winner’s city of residence to the location of the Hunt. All travel arrangements will be made by Sponsor, whose decisions regarding the itinerary are final. Selection of airline and airport shall be at the discretion of Sponsor or its designee. Airfare is subject to availability. The Grand Prize Winner must have valid travel documents (e.g., government issued identification) prior to departure, and failure to do so may result in forfeiture of all or some aspects of the Grand Prize. The Grand Prize Winner is solely responsible for satisfying all legally required conditions of travel. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation or delay or any weather or airline issues that prevent the Grand Prize Winner from traveling, in which event any missed portion of the Grand Prize trip is forfeited in its entirety and no substitution will be provided. The Grand Prize also includes lodging for the duration of the trip at Sponsor’s chosen location, meat processing, and meals up to a maximum value of $1500 All hotel and airfare taxes are included. All other expenses not specified above including, but not limited to, baggage fees, ground transportation, meals, beverages, gratuities, incidentals and taxes are the sole responsibility of the Grand Prize Winner. The Grand Prize must be booked a minimum 30 days in advance of travel. The estimated retail value of the Grand Prize is $4,615.00. Final actual value may vary at time of booking. Any unused portion of the Prize is not transferable or exchangeable and cannot be redeemed as cash.
Second Prize Package – Each Second Prize Winner will receive: one (1) Phone Skope Gift Cards $80; one (1) Leupold GO Afield Bino Harness; one (1) SneekTec Sneek Boots; one (1) Dark Energy Poseidon Portable Charger; one (1) Sitka Gear Hat/Gaiter combo in Open Country $179; one (1) #Huntsmarter Gear Package and two (2) Voke tins and sticker. The estimated retail value of each Second Prize Package is $587.98.
Third Prize Package – Each Third Prize Winner will receive a one (1) year Hunt Premium Membership and one (1) #Huntsmarter Gear Package. The estimated retail value of each Third Prize Package is $74.97.
The estimated retail value of all prizes is $63,787.85. Taxes, if any, are the sole responsibility of each prize winner. Sponsor makes no warranties or disclaimers concerning any prize beyond those customarily given by the manufacturer of the prize. Sponsor reserves the right to substitute a different prize of approximately equivalent value in its sole discretion.
Privacy: By submitting an entry, participants acknowledge and agree that any personal information that they provided will be maintained by Sponsor in accordance with Sponsor’s Privacy Policy, which can be found at https://www.onxmaps.com/hunt/policy. Participants further acknowledge and agree that any personal information provided by entrants will be shared with Sitka Gear, Leopold, Phone Skope, SneekTec, Dark Energy, and Voke, which will maintain participant’s personal information in accordance with their respective privacy policies.
RELEASE AND PUBLICITY: ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, RANDY NEWBERG, MATT SEIDEL, ALL PRIZE PROVIDERS (INCLUDING BUT NOT LIMITED TO Sitka Gear, Leopold, Phone Skope, SneekTec, Dark Energy, and Voke), AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AFFILIATED COMPANIES, SUBSIDIARIES, SUPPLIERS, DISTRIBUTORS, ADVERTISING AND PROMOTIONAL AGENCIES, AGENTS, SUCCESSORS AND ASSIGNS (THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE CONTEST. ENTRANTS AGREE THAT NEITHER SPONSOR NOR RELEASED PARTIES ARE LIABLE FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING FROM PARTICIPATION IN THIS CONTEST AND ACCEPTANCE, POSSESSION AND USE OF ANY PRIZE. SPONSOR IS NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL OR OTHER ERROR IN THE PRINTING OF THE OFFER OR ADMINISTRATION OF THE CONTEST OR IN THE ANNOUNCEMENT OF THE PRIZE. By receipt of the Prize and by signing an affidavit of eligibility and liability/publicity release, if requested, each Winner consents to the use of his or her name, and address by Sponsor for advertising and promotional purposes, without any additional compensation, except where prohibited. No entries will be returned. All entries become the property of Sponsor.
DISPUTES: EACH ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORTING TO ANY FORM OF CLASS ACTION, PURSUANT TO ARBITRATION CONDUCTED UNDER THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION, TO TAKE PLACE IN MISSOULA, MONTANA (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANT AND SPONSOR IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MONTANA, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW, RULES OR PROVISIONS (WHETHER OF THE STATE OF MONTANA OR ANY OTHER JURISDICTION) THAT WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF MONTANA.
